In the last hearing at the Court of Appeal, the panel of three judges led by M.F Shuaibu reserved their judgment after listening to the arguments of the lawyers for Governor Adeleke of the Peoples Democratic Party (PDP) and former All Progressives Governor, Gboyega Oyetola.

The Independent National Electoral Commission (INEC) declared Adeleke as the winner of the election, after he polled a total of 403,371 votes. According to INEC, Adeleke won 17 out of the 30 local government areas in the state.
However, the election petition tribunal, in a split decision of two-to-one, cancelled the election and declared Mr Oyetola of the All Progressives Congress (APC) as the winner of the election. The tribunal, led by Terste Kume, directed INEC to withdraw the certificate of return that was given to Adeleke and his deputy, Kola Adewusi, after they were sworn into office. According to Mr Kume, the tribunal held that the way the governorship election was conducted did not comply with the Electoral Act of Nigeria. The tribunal also found that there was over-voting in that election.
Today being the 24th day of March, the court of appeal gave it’s judgment at Abuja, upholding the victory of Ademola Adeleke. Thee court cited that the prosecuting party lacks evidence of over voting as alleged.
Senior Advocate of Nigeria, Onyechi Ikpeazu represented Ademola Adeleke while another Senior Advocate of Nigeria, Lateef Fagbemi represented Gboyega Oyetola. Oyetola is the former governor who contested to come back as governor but lost the election.

Governor Ademola Adeleke is the appellant, while Gboyega Oyetola, the All Progressives Congress (APC), the Independent National Electoral Commission (INEC), and the Peoples Democratic Party (PDP) are the first, second, third, and fourth respondents, respectively.
